After further investigation I have found out that the Thruway authority is using inductive loops to determine speed at EZ pass lanes and not radar or laser. Inductive loop technology is only useful for determining the average traffic flow or speed averages of multiple vehicles. It is highly unreliable and highly prone to failure and has a accuracy rate under 85% and the higher( further away) your vehicle mass is from the road surface the more inaccurate the measurement. Meaning a pick up truck or flat bed truck will be measured at a speed different than it is traveling.

 Thus my vehicle being flagged when I don't speed threw the toll exits.  There a huge difference from 16 MPH to 31 MPH and it is ludicrous that I have to go threw all this because they are miss-using there equipment  for something that it is not designed for or accurate for measuring. I have to appeal a suspension in the future of my EZ pass account when they have no way of accurately measuring my vehicles speed in place and are using equipment designed to estimate traffic flow and estimated average speed. 

This is government gone berserk! At the very least they shouldn't be sending violation notices to pickup trucks and flat bed trucks, if those are known problems vehicles for there equipment, they should also increase the flag rate to 15MPH over even though they inform you its ten miles over on there site if the equipment is prone to error. If not they should not use the inductive loop system at all and not send out violations until radar or laser is installed at each un-manned EZpass lane.

Then again I don't know if I believe that the equipment measures other vehicles speed accurately and if this is not happening to everyone at that exit, because while Phil was very helpful at that exit on the phone, Cindy at the Buffalo office was very difficult and evasive even though she did tell me they use inductive loop technology and my appeal was in and she had a copy of it in front of her, and she did question my data, but after I explained the graph and the map where intertwined and when I moved the cursor on the graph it moved the blue dot on the map she seemed to soften here stance. This could mean she is looking at an engineering perceptive and trying to understand the problem and not necessary cover up anything and they though they had any problems with the inductive loop technology figured out and fixed or they wouldn't be sending out notices, if she didn't think so, it also probably means Phil wasn't so sure the problems where fixed.( Even though that exit had just undergone extensive construction and upgrades).

 By some quirk of Luck I had discovered that when the NYS Thruway Authority and EZ pass accused me falsely of going 31 MPH Threw a 20MPH EZpass I was actually going 16MPH( not 26MPH as I originally thought) because I had my GPS Unit a Garmin 301 Running and tracking my driving that day.  The Image below is complied by Garman Training center software from my GPS on the day and time in question.

The 4:32:31AM. time is when the Lap started at my place in Gowanda I went to take my ma from my sisters to the airport I took RT219 to airport and came back the thruway, according to my GPS I went threw the toll both about 9 minutes before 6am the cursor and the blue point on the graph move  together and I can't upload mapping data to the GPS only download mapping data which is displayed in the program as above.

As you can see above my speed on approach was never over @30MPH coming into the booth and went as low as 16 MPH

I put the graph above because it shows not only speed but grade and elevation  at the EZ pass lane, 3 points of reference!

There nothing worst than getting falsely accused of doing something. It even more frustrating when its a machine or automated system that's doing it.

The reason that it's more frustrating is that the courts and the powers that be often take a machine evidence as infallible, but this is often not the case. In the case of traffic light cameras municipalities actually allow the companies that install the cameras to shorten the time a yellow light stays yellow so that if you enter a traffic intersection when the light is green and it turns yellow while you are in the intersection your vehicle doesn't have the time to exit the intersection before the light turns red, resulting in a violation, the only problem is they don't inform you or the courts of this fact or the courts don't care.

Then there is EZ-Pass a convenient way for the government to collect tolls (user taxes in reality) and track your cars every move. It is possible for police to point a device at your car and identify everything in your EZ-pass file although they don't tell you this. It also monitors your driving habits and speeds threw the toll barriers.

The only problem is I know I am not going more than the allowed 10 miles over the posted speed allowed in un-manned toll booths at the end of the lanes posted at 20mph, but for some reason exit 57 claims I am, and from the sudden deceleration of other cars going threw those barriers well below the posted speed it must be happening to a lot of people.

Another frustrating thing is when I originally called EZ-Pass about the notices a couple months ago they told me that the notices where being generated by the toll both collectors manually, so I am thinking that it was the old guy at one the toll booths doing it, so I complained at the toll booths because I always make a complete stop at manned toll booths. They gave me the runaround telling me to call EZpass and the woman got nasty.

Today while investigating I called the non-emergency number of the state police, they told me that the toll collectors can't generate notices and I've been told wrong by EZpass and that I should call the thruway authority and ask for the toll supervisor and after a little work with reluctant toll both personal( one lady that got sworn at and told to get off the phone f'in phone by an impatient toll payer) I was able to connect with Phil and although the guy was polite and concise in what he was saying. I was a little suspect in the numbers he read me and a pattern was developing of conflicting data between when I entered at that toll barrier and when I exited at that toll barrier. It is also suspect because I go threw the other unmanned 20mph toll barriers at Silver creek and Dunkirk the same way I do at Hamburg, yet I have never received a warning notice from those toll barriers.

Please be informed that I know that you can not go over ten miles over the posted speed or you will get a violation. I have known this since I got my EZ-Pass account.

I have never gone over the posted speed by more than ten miles an hour.

If it is a manned both I always pull the furthest to the right as I can away from the toll booths worker so he doesn’t have to been over by mistake, and sometimes I wave. I also always come to a complete stop.

Further if the speed limit of an unmanned both is set at 5mph I do not exceed that posted speed ever.

The reasons I do the above is I don’t want to run over and kill a toll both worker by mistake or make there job any harder than it already is.

When the posted speed is 20 MPH I go threw the booth at 25 mph because I am not worried about killing anybody if the speed is 30 mph I go threw at 35 mph because I know you get a violation at 10mph over.

At 5 miles per hour over the posted speed I should have enough cushion that even if my tires are not the exact size that came on my pickup truck according to a conversion table I have my speed should only be off by 1.8% which is almost non existent difference.

I know %100 for a fact that the violations and warning that you have sent me are because of equipment failure, or miscalibration of your equipment, or fraud on the part of EZ-Pass or the thruway authority.

I further suspect that an exorbantly high number of violation notices that are false are issued at the exit 57 toll barrier.

I will further point out. That even though the speed limit coming off the exit is 20mph, it has become a danger with EZ-pass cars slowing suddenly to speeds of about 10mph to go threw the 20mph lanes having the effect of cars and trucks not knowing of the scam almost rear ending the cars that know of the scam by the thruway authority at exit 57.

I mistakenly though the other 2 notices where from exit 57a so I had forgot about the scam. I though it was manned toll booths generating the false speed warnings so instead of using the thruway I have been driving alternative routes unless I forget and take the thruway. I though this because there is some old kook that hangs out of the both and yells and scolds drivers when they go threw the booths when they use EZ-pass, even when they go the speed limit and make a full stop.

Further I have talked with the toll supervisor for exit 57 and I noticed a pattern when he was reading my speeds off. I noticed that when I enter my speeds where within the 5-7mph range. This proves my point that I go the speed limit with a cushion of 2mph for error at the 5mph booths.

But when he read the other side off, the only speeds he indicated where a violation speeds of 31mph in a 20mph.

This is suspect to me because I know my speed is 25mph and for me to get 3 notices at 31 mph is further suspect.  It either indicates I am going threw consistently at 25mph and the calibration of the equipment is off or I am being scammed because 11mph over is the magic number for a violation.

I would like to point out that it is highly unethical, unmoral, and or negligent on the part of the thruway authority to create a condition at the unmanned EZ pass toll barriers that will most likely lead to accidents and possible deaths because you are creating a condition in where those who have received a violation which are highly suspect and probably false are slowing well below the posted speed of 20 mph to 10mph with other cars going 20-30mph. You are forcing two different rates of traffic and as you well know speed doesn’t kill, its traffic moving at different rates of speed that kills.

In conclusion I appeal my account suspension before it goes into effect and all violations and open citations.

Further all though I enjoy the convenience of EZ-pass, all falsely accusing me of speed violations will do is force me to use alternative routes and not the thruway or just abandon the EZ-pass system completely.
