I am
Happy to Report that my mothers problems with the NYS Tax Department below
have been resolved after complaining online, before my formal complaint even
reached them in the mail. They called her and the lady on the phone was
apologetic, had already returned the misappropriated funds to my mother's
bank account and set up a reasonable payment schedule on the phone. I don't
know that ladies name but I commend her and the NYS Tax department for there
fast action maybe change is happening and that abusive guy is an exception
from the norm!

would also like to commend NYS Tax Department Employee Sally Ostrander!
NYS Tax Department Employee Sally Ostrander is the original NY State tax department employee in the appeals department that after years of going back and forth with the tax department understood what we where saying and fixed the mistake over the phone in minutes and reduced my mother tax from the 20k that was wrong to $941 which she could live with.
The following is a true story as told as my opinion recollects'.
I called with my mother on the phone (three-way call to her place) to try
and arrange a installment agreement with the NYS tax department about 3
months ago for $941 reduced from around 20k that by all the principles of
mathematics and laws of physics they just pulled from thin air a number they
liked (I really think they hire people that can't do basic math, until you
get to the end of the appeals process which is after about 5 to 10 yrs of
going back and forth with idiots that can't do math) because they found out
the IRS auditing my mothers past tax returns( they report to each other now
electronically by computer). The guy on the phone was belligerent and
demeaning and kept laughing at me and my mother and discredited everything
we said. He made fun of both of us. Kept inferring we are liars. He refused
to make payment arrangements. Further through questioning he knows that all
of my mothers income comes from and everything in her bank account comes
from retirement funds yet her exempt funds where still levied on the 3rd of
this month, even though he knew this, this man was belligerent and refused
to make payment agreements.
My mother still started to send in money every month missing one
month, in order to pay what was due. Also even though we explained that all
this came about from the IRS adjusting her taxes and NYS adjusting her taxes
to match the IRS adjustments without regards to NY State law which differs
from federal law when it comes to deductions and retirement and we where
told by other tax departments employees that she couldn't make payment
arrangements until all tax issues where solved the Tax collector didn't care
that that was the case and told us we where lying while laughing at us.
He also didn't care that the department made mistakes and tried
to tax her about 20k and she only ended up owing $941 which most of the
interest was caused by her fighting this for years. The interest could have
been reduced by the amounts owed her but past the statue of limitations that
wouldn't be refunded.
Did you know if they go and audit your returns they will go back
7 yrs but if they find out they owe you money they won't return it to you,
if its past 3 yrs, say you owe them $400 in one year and it adds up to $900
with penalty and interest they will issue a tax warrant( talk about bull
shit due process and 100 % conflict of duties, the tax department acts as
prosecutor, judge, appeals judge and as an acting sheriff for enforcement,
they issue liens, everything in house, never having to ask a judge for
permission) for the $900 but the money they owe you (I think in this case a
couple of thousand) they will just say can't refund you the money it is past
3 yrs statute of limitation.
You say, but they are only suppose to go back 3
years, that's the law. Well, its also the law that if the IRS
audits you for any year no matter when, NY will also audit you for that
year, even if its past 3 years and they will back date the interest and
penalty to that year, if they determine you owe them money, but if they owe
you money its like it never existed. Like I said NY state could owe you
thousands, but it won't go against what you owed them with interest and
penalty. Luckily my mother has never cheated on her taxes, but she is still
being treated like she had.
You know it's just about gets to the point that I'm getting
board with writing this web site, but then somebody working for the
government specifically in the enforcement division of government will abuse
his power in dealing with me and my mother and I say to myself it's a wonderful
world, their's always some A-whole out there to give my life some
aggravation by
giving me something to write about.
Actually, I hate having to write about people who are
abusive, it detracts from what's good, what life's is about.
I could care less about these people accept for
the fact that they seem to prey on the weak and elderly( such as my 69 year
old mother) as much as those that they should be after.
If any of you think I'm a mothers boy, its like this when I was young I moved away and spoke to my mother maybe once a year for 10 years, but after my father died my mother's, mother ended up at her house and since my mother couldn't make ends meet, I moved back to Cheektowaga and paid my mother $800 a month rent to use a bed room( money that would find it's way into my brothers hands), I was always at work or dating dinning, health club, and cycling 30 miles a day outside so it didn't really bother me( the only thing that sucked was having to cut the grass on the weekend).
Then when we brought the direct mail franchise I practically lived in the office and on the road.
Now my mother lives between my 2 sisters houses, it use to be with my brother part of the time too. So no, I wouldn't say I'm a mothers boy. I'm a man that has done what needed to be done.
It's funny when your young you want to go out and do it on your own with out your family even to the point that you don't even call your mother on the phone for a year, ten years in a row.
Now, I'm not hung up on things like that. I've got nothing to prove to myself or my family, or society, so I talk to my mother a couple times a week at 69, I figure she's only got 20 or so more years left, about the same amount of years I have left if family history proves it's self out.( The woman live long, the men die young).
On this site as well as in my life I believe every good thing you do makes you a better person and goes in the plus column and every questionable thing you do adds up in the negative column and before you know it your not a person of any worth if your constantly doing negative things. That's why integrity is so important, all integrity is, is doing all the little things day out and day in that are fair and just, so when you do temporary get mad or experience rage you don't do something really stupid and you have something to come back too. If you don't have integrity it's easy to be abusive all the time.
Yes, I'm filling a formal complaint too! Maybe I'll sue him too!
PS: I’m not stupid, I know when I’m being told FU, I work with the tax department, I’m beyond accountability I’m going to FU your mother just for the fun of it, any lame explanation saying he was just doing his job within accepted parameters and does not include suspension without pay for that employee may result in a law suite be me.
