I am going to address this issue first because the open meetings laws exist and public comments meeting exist for just that public access and comments.

 Second public officials are just that public officials and as such you cant say what ever you want about them in the discharge of there duties, you can call them liars, call them dishonest, call them crooks and you can do this in public private and in the media and on the internet and it doesn't just have to be an expressed opinion.

They can't hold you liable for such statements even if they prove to be untrue.

Further at public town or city  meetings as at court and legislative sessions, you or the legislators can say what every you want about anything and can't be held liable for slander, or defilation of character. 

They are also not allowed to censor your speech. If they allow 3 minutes per person in attendance to speak you can say what ever you want and they should just sit there and take there medicine if they don't like it.

 "The way I was talked to.. I'm sorry. I'm not going to take it." said Smith. He says it was Kamery who was out of line at that meeting.  But many of Smith's colleagues believe he is wrong for banning anyone from speaking, including Kamery.

Now if you disregard the rules and won't sit down after your time they may have the right to have you leave and if you cause a disturbance or threaten one of them with bodily harm you could be arrested or ejected or barred by a judge for a period of time from attending.

But to bar a woman from speaking to be ridiculed as a joke by the town attorney after the session is over. It's not only illegal it could lead to a law suite for defamation by that woman. I have to also agree with that woman there's something wrong when taxes are as high as they are and the City is running a deficit budget and she should request the State Comptroller audit there books. It sure looks like they are very defensive over this almost to the point of suggesting a cover up of wrong doing by the board.

I mean my sister from what I understand was always critical of the North Collins Town Board for Financial matters and they made her a board member. They didn't ban her from speaking!

I myself have been critical of Marian Vanni and her obvious conflict of interest, influence peddling and questionable dealings and her holding a job with Belmont shelter an organization that is just blindly dedicated to woman's issues and placing unwed mothers in housing giving them and their boy friends cart blanc to run amuck and not enforcing rules that require section 8 and other HUD subsidies be adjusted to account for the income of the boyfriends that move into the apartments with the woman and kids.
