Promoting integrity and fairness in police departments when it comes to police dealing with the general public. Non-criminals. Lets be honest folks when I grew up I was told the police man is my friend. The police man was their to help you and protect you from the criminals thus the term protect and serve. Well, I grew up and I know that's pretty simplistic, but a police man, police woman's, employing  police department is judged by the public as only as good as the lowest common denominator (police officer) which is the worst police man , police woman, police officer.

FYI-My personal opinion on current events.

Knowledge. That's the thing about being in sales almost all my life, a good sales man is like a good shrink, they listen to your problems,( you can only determine need by listening, then plan a successful win win strategy between you and your client, and sometimes you knock one out of the park, the customer spend a couple of grand on advertising and they make a couple of 100k legally, sometimes it's the turning point in a business life, your customers been sleeping in the closet in his restaurant working 150 hrs a week, and everything he's been doing isn't working, he's still losing money, then your advertising campaign hits, there is a 4 hour wait at his door, but nobodies leaving the line, this is everyday for 4 months solid, he's been training and keeping his employees in a job and thanks to the advertising campaign I put together for my client he's grateful, all his friend are grateful. I get free food and drinks everywhere, I'm judging beauty contest, etc , etc. Some people know how to show gratitude) and  you don't tell anyone else anyone else's business, customers don't want someone who's going to spill your secrets to your competition, also because people sometimes go on with what they do, legal or illegal when you visit them, when they are comfortable with you and trust you, you become privy to things you don't want to necessary  know. That freedom also gets a lot of sales people on a wrong track, running numbers or dealing drugs, and they tell you stories that you don't want to know too. After 30 yrs your a walking encyclopedia of knowledge good and bad. The thing is I haven't been active in any business or sales activity since 1999 in NYS. It's 2007 there is nothing I can even be framed for that the statue of limitations hasn't run out on. So the cops can't force me to rat, and like a good American I reported all my terrorist concerns, before and after 9/11 happened, even though they went un-heeded.

 I want to say then there is the idiot that makes a million from the advertising your giving him for cost because his wife is employed by your company and she's a old friend of mine and he screws me out of $2k still he owes me, threatens my mother to boot and isn't declaring 90% of his profits to the IRS or state and cost me the hottest woman most men have ever seen because when he threatened my mother on the phone, I went ballistic and scared the heck out of this woman. She was madly in love with me before that phone call, as I was with her, but she wasn't after it. Yet, he's still walking the face of this earth as far as I know! Anybody ever say I'm not a nice guy, or doubt my religious beliefs Frankie B. is still walking the face of this earth unharmed by me. That's all the proof you will ever need. Also, if you think you can do anything to me that hasn't already been done or scare me or goat me, or intimidate me. The Good...

I prefer not to fight my battles in court, unless in small claims in Buffalo, the only place in NYS I can see their almost no bias. Your case is heard by an arbitrator, but I almost never lost their if I showed up; ok,  I lost twice out of around  39 law suits. People try to get out of paying for non tangible services like advertising because they don't get to feel the product in there hands physically even if it works, so you are last to get paid unless they are smart and see the value.

If you want to sue somebody in small claims court in Erie County using the  Buffalo NY Location instead of a town or village court that may or may not be getting free goods or services from the business you are suing located in their town or village. They will likely side with their friend's that own the businesses as in most criminal cases involving businesses within their town or village. If that person or company has a location, any location in Erie County NY you can sue here. I once sued Ford( I love Fords and drive a Ford and my father worked at the plant as did I at one time. My family and extended family and most of our friends drive fords courtesy of the z plan, Ford's are great! F150's make Chevys' look like old, old, old people pickup trucks) and in my opinion the dirt bags liars are at C. Basil Ford on Walden Ave in Cheektowaga, but  because Ford has a stamping plant in Erie county, Blasdell that location made it easy for me, so I could sue with out getting a expensive lawyer.  If you live in Erie county fill this form out in adobe acrobat reader or by hand and take it with either $15 or $20 down to the court. If you wanted to see lawyers burned and mad because they lost to you, this is the place. The thing is, it is other lawyers acting as arbitrators  making the judgment. I have to say nothing is guaranteed and sometime you lose, I lose. If it's a toss up.

 I just let it go, but if you defrauded me, or my family on purpose, almost out right stole and don't settle when I offer or offer me $101 or something ridiculous' instead of owning up, (hey I know people get desperate sometimes), I'll string it out make sure you pay your lawyer 10 times what you stole from me.

Yesterday while in this same court, after trail.  The hearing officer couldn't quite understand that NYS law prohibits pawn shops from selling your pledge before notifying you the properties owners 30 days before these sale, because quit frankly she probably never used a pawn shop and the defendants lawyer offered to pay $141.00 back to my brother and me on a computer system that was worth $1500.00 that I put together for him and I am still paying on.

 The $141 was the profits from the illegal sale, most people don't now that if a pawn shop keeps you property or auctions it off after first running 2 advertisements in the local paper, after having your property and not receiving payment for it for 4 months, it use to be 6 months. If they send out a notice 30 days before the sale. The pawn shop can legally sell the pledge, but the pawn shop has to return the profits of the sale over to you or the state of NYS unclaimed property department.

 But this pawn shop commits fraud and wants to steal your pledged merchandise and illegally spend the proceeds from the illegal sale of what you own, so they don't send you a notice 30 days before the sale. So you don't redeem your property, you lose it. I am also pretty sure they spend all the money they get from the sale and this is the only time they have been called on it, so they said they will pay the $141 profit, but since 2003 they have probably never done this for anyone. They have probably broken the law a couple of thousand of times yet they are still in business.

This is how it goes in our family: If my brother is short on money he goes and pawns something.

After a bunch of times making the payment on time and getting new pawn tickets he gets in the situation where he can't make the payment. The pawn shop sends him a notice to pay or lose the pledge, he then takes the ticket to me or my mother and I go down to the pawn shop and redeem it with him. This has happened at least 30 times over the years. He's a pawn shops dream customer. I will never let the property go unredeemed because the pawn shops around her don't give you 1/10 of what your properties worth. It is always the same with somewhat reputable pawn shops.

Evidently, Cash and Go Pawn Inc. of Depew NY and doesn't do either and keeps the money for himself illegally.

They also don't follow the law on many things. Because a pawn shop deals with peoples property that they bring in in desperation sometimes. NYS state mandates open books, police and head of local government oversight and continuing education of pawn shop employees to prevent them from stealing your pledges and to keep them from dealing with stolen items and laundering money, but evidently in Depew NY no ones at the helm of the ship and also this hearing officer although a very bright young black woman could not comprehend they where fraudulently stealing $1500 out of our hands by illegal trickery, it is against public policy in NYS to require a person to waive his right to a notice that's there to protect consumers and even if people do, if you don't send that notice you have committed theft.

The Ugly!

Anyway after court I went and asked the opposing attorney if he wanted to make an offer and settle this before the ruling of the court came down. I was thinking of around $500, but would of settled for $300.( In the end in June we settled for $400 and talking to the Lawyer on the way down to the street after court, after we met with the Judge in his chambers and the judge, Judge Broderick, negotiated a settlement, a fair and wise judge at least in this matter and remember I think I've always been treated fair in this court building win or lose , the Lawyer turned out to be a nice guy Richard Sherwood, he had a family, a couple of boys and a NASCAR racing fan). Just because it is my policy is to always try to settle as the bible says. I ask him if he wants to settle because if I lose I will ask for a trail denovo( new trail), even if I win $141 that they admit they owe.

 He offers me $101 in a smart ass way. I tell him with his client standing there. I will make sure his client pays you more than I lost, I will tie this up in court and complain to every government agency there is. I am not going to let them perpetrate wholesale fraud on me, my family or anyone else.

I'll tell you what's going to happen! I don't back stab! I almost always give a warning. I'll Report the lawyer for every infraction he makes to the bar and I might still win the new trail, the appeal, the second appeal, the 3rd, hey I might even take it to the US supreme court. I have plenty of time and I wont hire a lawyer it's not going to cost me anything but time which I have. All the time you will be dealing with  complaints to every federal state and private complaint organization there is and maybe multiple court orders, every taxing authority the IRS, NYS, there is, plus every licensing authority there is, the attorney general ,and after 20yrs of that, I might lose interest, but the bureaucrats won't.

 Also I'll open a website about you and print truths about you and my opinion about you, your business, your life and every time you try to discredit my truthful opinion, I just turn the flame up a bit more, I have a huge vault.  I'll put some video of you up on You Tube, etc, etc, etc... Most people that read what I write must think there is nothing to it, but there hidden meaning in everything I say and most often only the person I'm writing about will know what I am talking about unless you really screwed with me personally illegally.

 Are you sure you don't want to settle. He tells me he's a good client, actually he tells his client he a good client. By this time where at the elevator and he gets an attitude don't get in the elevator with them, he doesn't want to talk to use any more. I say take the next elevator then.

 Then a cop from inside the court room we where just in comes up from behind he must of herd us discussing a settlement deal. He sticks his hand out and get between us and tells me and my brother not to get in the elevator. I stop look at the guys arm badge and it a sheriffs deputy.

I tell him a sheriffs deputy. I don't have much respect for sheriffs deputies the New Sherriff I do , but not most deputies. I faked mad. I had just as much right to that elevator as the lawyer and his dirt bag client. But I don't get belligerent I just talk. Their a line between belligerent and threatening and combative  or expectable aggressive, or passive and loud. Even though I say I don't respect the sheriffs deputies to this cop. I give him the appropriate respect when he told me I wasn't getting in the elevator I didn't and I backed off. That brings me to a question, I been trying to answer myself since I started this site.

A Missouri Judge let a pedophile child rapist that rapped a 9 yr old girl out on probation when the prosecutor asked for 15 yrs prison sentence. In my opinion only a child molester rapist judge would let a child molester rapist walk without any jail time. If he sentenced the molester to jail he would have to see his own sickness in himself and since he probably thinks he is above the law he made a decision that shows his contempt for the law and all that want child molesters like himself in jail.

Studies have shown that the leading cause of death in  work zones in the length of the lane closures.

What a stinking way to end a New Year shooting a mentally disturbed man dead. This happened on 12/31/2006.  A  Rookie Erie NY county sheriffs' deputy shot and killed a man after his partner was either knocked down or stumbled on uneven ground and a disturbed man came at him with a knife. They say that a man can cover 12 ft and stab you before you can draw your gun, so shooting someone dead when they only have a knife is an approved method by most police departments. But most police officers now sport bullet proof vest that are also resistant to knife penetration, so a baton, or another a less lethal method such as a tasser or pepper spray would have probably defused this situation( this is when you use these less than lethal options). You don't use them to subdue non- violent black woman mouthing of to you sitting in there car asking for your badge number (video). This person had a history with the cops and the experienced cop probably knew that and better.  The kid freaked and shot the guy 3 times instead of one, he is not still in Iraq and while he might have been in his rights, I wouldn't be putting this guy back on the street anytime soon. They are saying 2 days, that ridiculous. He should go through some 2 or 3 months of consoling with a therapist and do indoor duty, maybe work with kids in Dare for a while, a little life affirming duty. This will assure his mental well being and the general publics safety, the guy might turn out to be a good cop that way.

I have to add two words to my comments above situational awareness what this means is these cops should have know better than to confront this man in the woods at his mothers house. They should have waited for him to come out in the open on the street or driveway. Also, if they knew he had a metal problem instead of barking commands at him they should have softened their stance and not agitated him and called for backup with less lethal methods available to them. It was not a situation in which anybodies lives' where in jeopardy until the police confronted him.

I heard on Howard Stern Show that the Soldier's( USA's Troops in Iraq) could use some Cable Ties: So I ran out and brought the biggest package I could get. I want to remind you guys that nothing is done in vain. Even Vietnam has embraced capitalism along with China and remember the iron curtains not there anymore. You do the math the world is a much better place than it would have been had we (by that I mean you our troops!) not gone to Nam and Korea, as it is so Afghanistan and Iraq now.
