I would like to ask the County Executive what's better? A Casino in Buffalo or Crack Houses in Buffalo? People Spending their Money Gambling and having a good time or Buying Illicit Drugs on the street? People spending their Money in Casino restaurants or in a Pizzeria that cheats on their taxes? 2000 Casino Jobs or 2000 retail or Burger joint jobs. A vacant dilapidated grain mill or a New Casino and Hotel. Yes we all know that if the NFTA didn't drag their feet on the waterfront property the Seneca's could have built a 80 acre Casino on the waterfront to rival Foxwood's in Connecticut and create 20k-40k jobs and been a international destination, but I guess in my opinion the kick back was to steep for the Seneca's to afford! All I have to say is sore loser, first their is a hard control board and now a Casino in Buffalo, in my opinion it's getting hard to divert government funds in WNY to your friends at office furniture stores and other places and people will probably be choosing to spend their fun money on Casino Gambling instead of Illegal Drugs, Booze, OTB'S, Lottery and Bingo.

Also Buffalo ended its 2005-2006 fiscal year in June $56.1 million in the black thanks to a control board and as the Buffalo fire department says the number don't add up. I say  they should be given their pay raises. I say figure it out, in my opinion it don't adds up because it's hard to divert funds out of government coffers when there's a control board auditing what is being done.

Lets be honest folks when I grew up I was told the police man is my friend. The police man was their to help you and protect you from the criminals thus the term protect and serve. Well, I grew up and I know that's pretty simplistic, but a police man, police woman's, employing  police department is judged by the public as only as good as the lowest common denominator (police officer) which is the worst police man , police woman, police officer.

About native Americans and Justice...

I have said many a times theirs no Justice in Justice courts and it seems that I am not alone in this assessment. While doing my laundry a couple of weeks ago I was told of and accident occurred with the death of 3 native Americans on route 438. From what I was told there was an accident with a van and a motorcycle across  from a tent reunion on RT 438. A group of native American men went to give assistance and a few minute latter they where mowed down by a teen girl talking on her cell phone and she may have been drinking. She also happens to be related to the town prosecutor( I am told by Native American telling me of this) or someone else in the judges office the story goes and of course the native Americans believe that no justice will be served.

The other day I told someone about this and they said they saw it on the news and thought it was odd they cleared the driver immediately without further investigation, since this person lives in the north towns he is not connected to this story so I figured if he thought it was odd, I will say something here.

You know out west there are rarely towns or villages located on reservations, so the bureau of Indian affairs and the FBI usually enforce what are federal laws on reservations and the tribal police enforce the reservation laws and the Indians more or less have self rule, but in NYS the Indians have all sorts of towns that intersect the reservations and are usually judged by non native Americans and prosecuted for braking town laws and the first responding police usually are town police or sheriffs backed up by state police and not the tribal marshal's.

I am going to suggest this solution that will give them self rule and let native Americans be judged by native Americans all courtesy of the state of NY.

Since the state  government won't recognize the Seneca's  rights to self determination, incorporate all continuous reservation lands into a village, or villages, easily done by a petition from those in the area to become a village and a vote, then  appoint  village justice of the peaces, village prosecutors, and elect a village government  to run the day to day operations of the village and even make all the Seneca marshals village police officers so they would have primary response, and even if the sheriffs or the state police ticket natives, or arrest natives, their case would be heard in the Seneca village justice court and you could do like all the other Justice courts and favor village people and hand out ACD's to offenders( I am not opposed to this practice ACD's , because I believe that everyone deserves a chance and most often ACD's are only handed out where the case could not be proved when the person is not guilty and should be dismissed outright, it's when they are used to prevent people in power or their children from getting even the least liability or punishment for their actions if they involved death of a person or persons, then its wrong), and also keep all the ticket revenue from  the reservation that now goes to the towns, it would go to the reservations village government, you would achieve self rule more or less because town laws don't apply in the villages, village laws apply. You could set your own speed limits noise ordinances, the works. Also you would be judging all the non-natives that commit crimes on the reservations and they couldn't hid behind who they know in the town governments.

Personally I believe that unlike the Illegal Mexicans and the blacks that have everything handed to them on a silver platter native Americans which have treaties signed by our government that allow them self rule on reservations and no taxes are continued to be vilified and denied their due and what was and is promised and besides now being allowed casinos which can help them get funds for self sufficiency( which less face it only is being done because that's the only option left to them and if foreign investors or outside interest couldn't make a pretty penny threw there partnership with the native Americans this avenue the  casinos would not exist for them either.

I noticed the speed limit on Route 438 on the reservation from the Gowanda Village line has been reduced to 45 mph where it was once 55 MPH. I was wondering if this is because the Native Americans asked for this to be done or if its and attempt to cover up after the fact for the teen driver that I was told is related to a government official locally( I was told this by a native American) by saying the state speed limit of 55MPH was the main factor in her mowing down and killing 3 native Americans and not talking on her cell phone, drinking or inattentiveness on her part. According to the NYSDOT.GOV  Speed limits are suppose to be set at 85% of the flow of non-peak hour traffic on a road. If this is so, this road rates the federal 65MPH or state 55 MPH speed limit. I would like to see the traffic or engineering studies that show the speed limit should have been reduced. I have not seen any testing equipment on any stretch of that road that was 55 MPH in the last year even though I do remember testing equipment at the cross roads intersection at RT 438 and Versailles plank but the speed limit their was already set at 45MPH and would have tested slower because it was at an intersection on RT 438 and Versailles plank and would have only indicated what a speed advisory sign should warn when approaching that intersection.

Personally I can't imagine the Native Americans asking for a reduced speed limits on RT 438 because at 45 MPH it is carte blanc for every cop that patrols Route 438 to pull over almost every car that transverses it. It will only end up in more native Americans ending up in Collins town court being judged by the white man along with their gas and cigarette customers.

 Also even though federal courts have ruled that states can collect taxes on Indian sales to non Indians and state courts have used that ruling also, after reading the state constitution, I can't see where New York State would be allowed under the NYS constitution and  NYS law the same right and using the federal rulings or state courts using that precedence is the wrong application of law. The native Americans would be better appealing to state and federal courts and the US supreme court on the idea that the NY constitutions prevents the taxation even if federal law allows it and let them decide on this matter using that precedence.

Also is there not a federal moratorium on state taxes on internet sales to out of state customers?

If this is so why can't the native Americans ship and sell to out of state customers without collecting taxes.

Also the US supreme courts has already ruled that companies that have no sales force or retail locations located in a state where they are selling mail order which should include the internet do not have to collect taxes on sales to customers in other states.

If these aren't correct assumptions their would be no reason to do what I suggest.

Yes I can also appreciate that the native Americans don't want a non-native like me giving them suggestions on how to rule, but I do see them trying to rally support for their positions with non-natives threw their treaties supreme law of the land campaign and internet sites.

I do support there positions, but I also think they have to be more like the blacks that did an end around and took over Washington DC and started paying themselves $150k a year a for bus driver jobs and other menial jobs and get the rest of the country to subsidized them by billions of dollars a year and the Mexicans that just invade the USA and get all the benefits awarded them by government and private business.

Now that this solution has been presented, if the Native Americans fail to act, the only people they can blame in the future for what happens is themselves or their leaders.
